Wat is het standpunt van de SEC over Bitcoin en Ether?<\/h2>

De SEC kijkt niet Bitcoin | Dit is wat je moet weten <\/a>of Ether<\/a> als zekerheden. Dit komt omdat het sterk gedecentraliseerde netwerken zijn zonder een externe promotor waarop openbaarmakingsregels van toepassing zouden zijn. De SEC ziet ze graag als handelswaar buiten de effectenwetgeving.<\/span><\/p>

Argument voor het feit dat Ethereum een beveiliging is<\/span><\/h2>

In een recent interview verklaarde Michael Saylor dat Ethereum duidelijk een beveiliging is en als zodanig moet worden ge\u00ebtiketteerd. Hij noemt de verschuiving van Ethereum van proof-of-work naar proof-of-stake, mogelijk gemaakt door gecentraliseerde controle, als bewijs. Ethereum had ook een ICO, wat gewoonlijk een kenmerk is van een beveiliging.<\/span><\/p>

Ethereum is al lang bekritiseerd als een niet-geregistreerde beveiliging die door de oprichters is uitgegeven om softwareontwikkeling te financieren. De Ethereum Foundation hield een ICO, vergelijkbaar met een IPO, om geld in te zamelen en tegelijkertijd de effectenwetten te omzeilen door in het buitenland te zijn. Be\u00efnvloed als het een beveiliging is<\/span><\/h2>

Als het als een effect wordt beschouwd, hebben Amerikaanse Ethereum-beleggers erkende makelaars nodig om ETH te kopen, verkopen en beheren. Ze konden ETH niet zomaar rechtstreeks kopen en zelf in bewaring nemen als een grondstof. De Ethereum Foundation zou waarschijnlijk ook miljoenen aan boetes verschuldigd zijn aan de SEC, vergelijkbaar met Ripple Labs.<\/span><\/p>

Ethereum zou niet verdwijnen als het als een beveiliging wordt beschouwd, omdat het nog steeds gedecentraliseerde apps en services aandrijft. Maar de verspreiding en toegang ervan zou beperkt zijn, vooral voor Amerikaanse investeerders en entiteiten. De SEC moet opnieuw evalueren wat consumentenbescherming werkelijk betekent. Risico is inherent aan markten en volledig elimineren gaat te ver. Het doel moet zijn om consumenten te informeren door openbaarmaking, niet om hun toegang te blokkeren. Consumenten moeten kunnen beslissen welke risico's ze nemen.
